Well, I didnt sell my bird. I wasnt going to give it away and so no one wanted it. I have it for a few more days . Due to mounting medical expenses and at least 2 more surgeries scheduled I have had to do something I never thought I would do . I want to tell all you so you wont be making things up and stretch the truth too much. After much deliberation ,prayer and discussions with everyone here I today had to file for bankruptcy protection. This way I have some dignity remaining . BUt, now I am a bad risk for everything. My bird will be auctioned off along with some of our possessions. We do get to keep a few things however so we wont be living in a box. I have to have the surgery ,so I had no choice. I am  disconnecting my internet and phone on the 27 th. After that I have no idea whats going to happen. Other than surgery on Oct 7.

No I am not looking for your sympathy. I am informing you of my present situation because I want all of my friends to know whats going on. So I will say so long ,thanks for all your input, prayers, kind thoughts and support during this ordeal. It is now something I must face alone. Just wanted you guys to now . Thanks for everything . I will always remember the Y-block website.  Take care Stay safe and God bless you all.   Earl Dagenhart 55birdman.

Y-Guy Earl:      Sorry to hear the "news"  It's sad that, in our country, if you didn't

have anything, you get the "help" almost free, but if you've worked hard, saved

a little nest egg, they will take it all.

I have a friend who's son went thru several surgey's and owed

several million dollars. They put him on a payment plan of several hundred

dollars a month and "wrote it off" It still shows up on his credit, but as long

as he makes those low payments, his credit score is fine. He bought a new

truck a while back, and the guy checked his credit and said  "hey you got a

lot of bills but your credit is Aplus:.

I've heard of people getting a divorce to keep from losing

everything.  I hope you can find a way to keep it together and not lose

         it all.

Earl, you'll always be in our thoughts & Prayers

                                                          Bill

Hi Earl,

Sorry to hear you've got to let the Bird go in an auction.  I'd love to have it but I know I can't afford it with everything else on my plate.

Anyway cars are possessions and it's people that matter, so you and the family stay strong and do what you need to do now.  As Bill said get online through a friend or relative's computer and keep us informed of how you're doing.

We all have to play the hand we're dealt, but it sure sounds like you were dealt a terrible hand.  We do not know God's plan, nor understand his ways.  We will not forget you, and continue to pray for you.

Earl, keep faith in God no matter what...

Prayerfully we can get together sometime - maybe over the holidays I can see my folks down in NC.

I do have your address and will mail you something soon.

Earl, I'm so sorry to hear of this happening to you.  I don't know what to say.  I would have loved to buy your 'Bird (my wife and I love the '55) but it doesn't sound like that would have made the situation much better anyway.  We will continue to pray for you and maybe you can check in on a friends computer to say "Hi" from time to time.

Wishing you all the best.

My son is going to allow me to use his computer in the future. I went to my attorney today and He told me as long as my stuff hasnt been auctioned yet I could sell what I could . So, I sold my Tbird to my son for a penny.  That way the sale is legal and it cant be touched. More than 1 way to beat the creditors.

When I read your post from the beginning, the first thing that came to mind is that you need faith and a good attorney. Looks like you have found the attorney and now you just need to keep your faith. There are a lot of us guys praying for you.

Glad to hear you can keep the 'Bird Earl.  Just so you know I would have doubled that amount. Tongue  Take care and good luck with what's ahead of you.
By 55Birdman - 15 Years Ago
Well the good side is I get to keep it and they cant touch it to use for cash to settle my 100K plus  (so far) medical bill.

Tim I would have sold it to you if I would have known. Thats double its worth. Boy am I stupid!!! I will keep you in mind when I try to sell it again.

Hey Earl.I am so glad you were able to keep it.I am pulling for you Earl!Stay positive AND stay in touch.

Earl, I don't know you in person, but I got upset when read what you wrote. America is a great Country, maybe the greatest in the world, but when people that work hard start to be treated as trash, it puts some thoughts on our minds. I had to sell my house and my Galaxie and a '73 Chavey Veraneio I had, back in '04 just to keep eating. My engineering office was closed, and my two associates changed their income source from Engineering to something else. With part of the money from the house, I bought a smaller house, and even being on total bankruptcy, no credor could touch my new small house, since here in Brasil, your place of residence is considered sacred, and can't be taken away from you. Everything else could, and I sold my two dearest cars for banana price. I'm Baptist, and never lost faith in God. I firmly believe He's with me now, and ever has being. I took three years of hard work to pay for my bills. In late 2007 I bought the Galaxie back, and now I'm slowly going back on track. My other cars, I transfered to my brother's name, and now they are back with me.

I believe greed is overcoming everything else, and the so called rich are working hard on getting richer, of course at spence of hard working people.

Helath care should be for free, It's for free here in Brasil, and we are a South American Country!! In England is free, in France is Free, in Germany is free, but a lot of people in the States refuse it, with fear of being called "socialist". Come on, that's just stupid!!!! America is giving a shoot on it's own foot. Lots of things are no longer made in the USA, to be competitive on the market, and this cuts jobs, and destroy America's tradition of greatness.

The fact of me being member of the Brazilian Socialist Party, even makes me a target for a lot of people, but we are NOT what you were tought. We don't eat little children, and we are not the devil. We just want that everybody has a chance, and we want that each one of all people have a nice decent life. I own four cars, so, that part about "no private property" is bull.

Michael Moore has a great film about what is happening, It's called Captalism, a love story.

Taking a person's house because he's ill, is not only not humane, it's evil.

Tulio, Having lived in Canada, I can't agree more. I don't like the way they rammed it down our throats here in the US. I'm really not quite sure how that was legal.

In Canada, it's not free, but it's easier to afford; sales taxes are 15%. You want to pay less? Buy less. It's easy to do when you look at all of the frivolous things you buy. That whole argument about it taking months to get care is BS. I didn't know anyone who didn't get right in to the doctor when they needed to. The only time i had to go to a doctor was for a broken arm. There was a short wait but I guarantee it's no different then going to the ER here with an injury that's not serious - with or without insurance. I had some friends and family who needed more serious care and they got in immediately. It works.

Earl, I'm glad you get to keep the bird. That was an excellent move. If I knew it would only take 1 penny, I'd have a Bird in my driveway right nowBigGrin.
By 55Birdman - 15 Years Ago
The way I understand it when one files for bankruptcy you turn over everything you own to be auctioned off and the monies are divided up amongst the creditors and paid. The creditors get what they get and thats the end of the story. You are allowed to keep things necessary to maintain a lifestyle. But, once they are paid they cant comeback and get you should you win the lottery. All we are left with is bad credit.

My cancer isnt covered by my disability and I am obligated to pay for treatment. Now that total is 67,000 plus. My next surgery will push that to 6 figures I am sure. My attorney told me to sell my car if I wanted to keep it. So, I did. I am glad I found a way to keep it.

I am fightiing with the VA about me being service connected for my Cancer. They say no I am opposite. But In either case I pay till its reversed. I am sure I got this from Agent Orange in 'Nam. Just like my Diabetes and all its related illnesses. But I have to wait. I will most likely die before they give in.

But for now the law says I give up what I own and watch it get sold. Not what I want but its what I have to do.

Charlie, I lived in Montreal back in the mid 90s and I never saw anyone die from not being able to see a doctor. I wasnt allowed to see a doctor there but even with that I got in to see them thru a friend. Un fortunately we have had insurance companies run our lives so long and they have and still do make billions dont want us to go with socialized medicine because they would be out in the cold . And we as a nation cant afford to do it due to the costs to start it up. So, we are at their mercy and more often than not they turn a deaf ear to us. Oh well I hope and pray I will survive the madness to see my grand kids get married and die of old age.  Surgery is Oct 7.

Tulio you are right. Capitalism sucks

Earlier you mentioned you were 100% covered by the VA what happend to that? Are you in contact with your local Disabled American Veteran assocition? They can be a lot of help when fighting the VA. Type 2 diabetes is on the Agent Orange presumptive service-connection list. If you are type 2 they award should be no problem. Chuck in NH

Earl

I am sure that I, like everyone else, sends their best wishes for the future and hope that you can beat the big "C".

There is absolutely no doubt in my mind that a lot of your experiences in "Nam are now contributing to your health issues.

Here in Oz we are a little more fortunate with the treatment of our exservicemen but for those that haven't served, the future is pretty bleak.

Here you work all your life, pay your taxes and either have to contribute directly or your employer is forced to pay superannuation (to insurance companies) to fund your retirement.

Recently they (our sanctimonious politicians) have raised the retirement age to 70 years, obviously because insurance statistics show that most people don't make the distance so the government can then figure out a way to keep the unspent funds.

A back bencher in our government collects $120,000 a year and only has to do two terms in office (6-7 years) and is then guaranteed a superannuation pension for the rest of his life over and above what he can earn in the marketplace. These blokes set their own salaries and conditions and have the audacity to say they speak for the people.

The joke in recent times is that they want to make our health system like the American model - those that can pay for the insurance get the health cover. All the rest go into the public health system and go on waiting lists. The irony of this is that our private health system is so expensive that everyone goes into hospital as a public patient - go figure.

Anyway, Earl glad you have got to keep one of the things most dear to you, but don't lose sight that everyday on this earth is to be enjoyed.

Keep the spirit.

Kind regards

Regards

Went to doctors today. I am scheduled for a 3 hour surgery they say. The doctor said that they have to go into my head thru my skull to be able to get at the mass in there. The plans are to remove the mass rebuild a new eardrum take the mastiod bone out and any other pieces left in there and get out. I have to wait about 6 months for everything to heal up a bit and then they are going in again and and rebuild the ear canal and install an implant and wire me for sound so I can hear. They seem to think the mass is going to be easier to remove than originally thought. I do have a hole in my skull from the mass and my brain is protruding into my ear cavity and thats another issue. They said they would take care of that when they get in there. They will cut off the section of brain tissue thats protruding and seal the hole. Sounds simple. We shall see. Oct 7th 8AM. Later friends thanks for everything.  Earl Dagenhart

Hey Earl, Keep the faith up, you will get through this. I don't want to get on the subject of Insurance, but between them and banks they own all the marble floors in the country. so we know who buys the politicians, the politicians are not for the people they are for the lobbyist who butter their hands. I think we need to take back the country.

Sorry to hear you had to sell your bird for a penny, hopefully your boy will give you a ride sometimes.

Again your in our prayers!
